Richard Dreyfuss on Real Time With Bill Maher

23 November, 2006, Thursday

Bill Maher – Richard Dreyfuss Part 1

Richard Dreyfuss has come out with the most powerful and inspiring call to action that I have seen in a very long time.

The audience was pin-drop silent and the other panelists -wisely- did not interrupt him even though he went on for far longer than what we’re conditioned to seeing on TV.

Watch this and be reminded of the folly and total outrage of some idiot cable news presenter saying to a guest, “Ok, we got 30 seconds left, so close us out by telling us what you think should be done about this complex and important issue we’ve been discussing for the last 7 minutes.”

Rush should watch this… however, his head might explode. – Tim

  2. I commend Mr. Dreyfuss for his emphasis that our society truly needs enlightenment of a good civics lesson in order for all to become better citizens. It is a real shame that most Americans claim a citizenship that does not exist legally. A three judge panel, all of whom were citizens of one of the several States and not citizens of the United States, stated unequivocally that “there is no such thing as a citizen of the United States”, see Ex Parte Knowles, 5 Cal. 300, 302 (1855). So why do Americans claim a citizenship that does not include the fundamental rights protected in the Constitution? They have been duped, as all have unwittingly registered to claim a benefit from the United States (social security) that the courts have repeatedly ruled allows the government to restrict or completely deny access to the courts. See Babcock, Tutan, Dismuke and other cases. How else can one file a writ of habeas corpus in court only to have the court change it into a motion whereby it rules that the motion is denied? Wake up People, you’re not sovereign citizens until you regain your sovereign rights as a citizen of one of the several States.

Think I’m wrong? Prove it with case law as you have no rights unless it is honored in the courts. And that is an entirely different story.

Can anyone provide me an email address to pass on these vital case law cites to Mr. Dreyfuss? I am coming up empty handed as he is well insulated.

  3. It would appear that the questions of state vs national citizenship have been addressed in the Slaughterhouse decision: (per Wikipedia)

“In a five-four decision written by Justice Samuel Freeman Miller issued on April 14, 1873, the court held to a narrow interpretation of the amendment and ruled that it did not restrict the police powers of the state. The court held that the Fourteenth Amendment’s Privileges or Immunities clause affected only rights of “national citizenship,” and not state citizenship. Therefore the butchers’ Fourteenth Amendment rights had not been violated.”

The duality of citizenship (state and federal) appears firmly established, and supported by case law. – Tim

  4. BTW, the “American Patriot Network” is generally the common source for most of the arguments that suggest national citizenship is mythological. Do a quick Google on that string, and you get a pretty clear picture of who they are, which firmly establishes their credibility (or lack thereof). – Tim

  5. The key issue with the Slaughter-House Cases you mention is that the national citizen has privileges OR immunitites and the state citizen has privileges AND immunities. This was reflected in the decision that the 14th amendment changed nothing that the States originally had – their citizens had fundamental rights from the first eight amendments whereas the the national citizen had the appearance of privileges of the white man. (Sorry for the preception of racism but this is the desciption as stated in the Cases.) Congress has no authority to enlarge or abridge the fundamental rights of a citizen of the several States, see Maxwell v. Dow. Don’t have the cite as I am not at my desk.

Short story is once an individual registers for a benefit from the government (social security), the government (Congress) can deny access to the courts and limit any or all remedies regarding any issue. Without fundamental rights one has stepped outside the Constitution to be completely under the plenary Power of Congress as in the Territories. All citizens in the territories were generic citizens of the U.S. and once it became a member of the Union, each citizen then became a citizen of the State with all the privileges AND immunities as found in Article IV, sec.2. I hope that I am making sense here. I will offer up some more legal cites validating this later.
